Article 1 — Purpose
These General Terms of Use (hereinafter the “GTU”) govern access to and use of the Kappn platform accessible at kappn.ai (hereinafter the “Platform”) and all associated services (hereinafter the “Service”), published by Kappn SAS. Access to the Platform and use of the Service imply full and complete acceptance of these GTU. If the User does not accept these GTU, they must refrain from using the Platform.Article 2 — Definitions
“User”: any natural or legal person accessing the Platform, whether registered or not. “Registered User”: any User holding an account on the Platform. “Account”: the personal space of the Registered User on the Platform. “User Content”: all elements (photographs, descriptions, addresses, buyer profiles) uploaded by the Registered User to the Platform. “Generated Content”: videos, voice narrations, and visual elements produced by the Service. “GTC”: the General Terms and Conditions of Sale applicable to Registered Users who have subscribed to a Subscription.Article 3 — Access to the Platform
3.1. Access conditions
Access to the public part of the Platform (information pages, blog, pricing page) is free of charge. Access to the Service features (video generation, customer area) is reserved for Registered Users who have subscribed to a Subscription under the conditions defined by the GTC.3.2. Technical requirements
The User is responsible for their computer equipment, internet connection, and the compatibility of their hardware with the Platform. Kappn recommends the use of an up-to-date web browser (Chrome, Firefox, Safari, Edge) in its latest version.Article 4 — Creation and management of the Account
4.1. Registration
Creating an Account requires providing: first and last name, professional email address, agency name, and password. The User undertakes to provide accurate, complete, and up-to-date information.4.2. Account security
The User is solely responsible for maintaining the confidentiality of their login credentials. Any use of the Account carried out with the User’s credentials is presumed to have been performed by the User. In the event of suspected unauthorized use, the User must immediately inform Kappn at [email protected].4.3. Account deletion
The Registered User may request the deletion of their Account at any time by contacting [email protected] or through their Account settings. Deletion results in the permanent loss of access to the Service features, subject to the thirty (30) day grace period provided in Article 14 of the GTC for downloading data.Article 5 — Use of the Platform
5.1. Authorized uses
The Platform is intended for professional use in the real estate sector: generating videos for the marketing of real estate properties, distributing videos on real estate portals and social networks, and use within the framework of customer relations (presentations, emails, prospecting).5.2. Prohibited uses
The following are strictly prohibited:- Using the Platform for illegal, fraudulent purposes or purposes contrary to public order and morality
- Uploading User Content that infringes third-party rights (copyright, image rights, property rights)
- Generating misleading, discriminatory, defamatory content or content infringing human dignity
- Reselling, redistributing, or making the Service available to third parties (except authorized API use under the Premium plan)
- Any attempt to gain unauthorized access to Kappn systems, servers, or networks
- Using robots, scrapers, or any automated device to access the Platform without prior authorization
- Reverse engineering, decompiling, or disassembling all or part of the Platform
- Circumventing security measures or technical limitations of the Service
- Using the Service to generate videos not related to real real estate properties
Article 6 — User Content
6.1. Responsibility
The Registered User is solely responsible for the User Content they upload to the Platform. They guarantee:- That they hold the intellectual property rights or necessary authorizations for the photographs and uploaded content
- That the photographs correspond to real real estate properties that they are authorized to market
- That buyer profile information is collected in compliance with the GDPR (valid legal basis, information provided to the data subject)
- That the User Content contains no unlawful, defamatory, discriminatory material or material infringing third-party rights
6.2. License granted to Kappn
By uploading User Content, the User grants Kappn a non-exclusive, free, worldwide license, limited to the duration necessary for the performance of the Service, solely for the purposes of video generation, storage, and display within the customer area.6.3. Moderation
Kappn reserves the right to remove any User Content that is manifestly unlawful or contrary to these GTU, without prior notice or compensation. Kappn does not carry out systematic prior control of User Content.Article 7 — Generated Content
7.1. Nature of the Generated Content
Generated Content is produced by generative artificial intelligence technologies. As such:- The generated videos are automated creations and not audiovisual works within the meaning of the Intellectual Property Code
- Neighborhood visual reconstructions are AI-generated representations and not faithful photographic reproductions of reality
- The voice narration is generated by speech synthesis and does not constitute the recording of an identifiable human voice
7.2. Usage rights
Subject to compliance with the GTC and these GTU, the Registered User has the right to use the Generated Content for real estate marketing purposes, as defined in Article 9.3 of the GTC.7.3. Inherent limitations of artificial intelligence
The User acknowledges and accepts that the generative artificial intelligence technologies used by the Service have inherent limitations, including:- Visual artifacts: videos may contain graphic distortions, visual inconsistencies, blurry or pixelated elements, or rendering anomalies (distorted objects, incorrect textures, elements added or omitted by the AI)
- Hallucinations: the AI may generate visual or textual elements that do not correspond to reality (nonexistent buildings, fictional businesses, incorrect points of interest, approximate distances)
- Variability: two successive generations based on the same data may produce significantly different results
- Voice narration: the synthetic voice may contain unusual intonations, pronunciation errors, or sound artifacts
- Neighborhood reconstructions: neighborhood views are AI-generated reconstructions and in no way constitute faithful photographic representations of reality
7.4. Verification obligation before distribution
The User undertakes to watch and verify the entirety of each generated video before any distribution, publication, or transmission to a third party. The User who distributes Generated Content containing artifacts, hallucinations, or inaccurate information assumes full responsibility for the consequences vis-à-vis their clients, potential buyers, and any third party. In the event of manifestly inappropriate content or content containing major artifacts, the User must refrain from distributing the video and may request a new generation within the limits of their available credits.7.5. No refund related to AI quality
Visual artifacts, hallucinations, rendering imperfections, and quality variations inherent in artificial intelligence technologies do not constitute a lack of conformity of the Service. No refund, credit, or compensation will be granted on this basis. Refund conditions are exclusively governed by Article 11 bis of the GTC.Article 8 — Platform availability
Kappn endeavors to keep the Platform accessible 24 hours a day, 7 days a week. However, Kappn does not guarantee permanent availability and cannot be held liable in the event of:- Interruptions for scheduled maintenance (notified 48 hours in advance)
- Interruptions due to force majeure events
- Malfunctions related to the User’s equipment or connection
- Interruptions related to urgent security interventions
Article 9 — Intellectual property
All elements of the Platform (architecture, design, source code, algorithms, trademarks, logos, texts, images, databases) are protected by intellectual property rights and remain the exclusive property of Kappn SAS. The trademarks “KAPPN” and “KAPPN.AI” are registered trademarks with the INPI. Any unauthorized reproduction or use is subject to legal action. Use of the Platform does not grant the User any intellectual property rights over the elements of the Platform, except for the right to use the Generated Content under the conditions defined by the GTC.Article 10 — Personal data
The processing of Users’ personal data is governed by Kappn’s Privacy Policy, accessible at kappn.ai/confidentialite. Users are invited to consult it to learn about their rights and the methods used to process their data.Article 11 — Liability
11.1. Kappn’s liability
Kappn is liable for direct damages caused to the User as a result of a breach of its obligations, within the limits provided for in Article 12 of the GTC. Kappn cannot be held liable for:- Damages resulting from improper use of the Service by the User
- User Content uploaded by the User
- The use made by the User of the Generated Content
- The content of third-party websites accessible via hyperlinks
- The consequences of disclosure of the User’s login credentials
11.2. User’s liability
The User is responsible for any damage caused to Kappn or third parties as a result of their use of the Platform. The User shall indemnify and hold Kappn harmless against any claim, request, or legal action brought by third parties resulting from their use of the Service or a breach of these GTU.Article 12 — Suspension and termination
12.1. Suspension
Kappn reserves the right to immediately suspend, without prior notice, a User’s access to the Platform in the event of:- Serious or repeated violation of these GTU
- Uploading manifestly unlawful User Content
- Behavior endangering the security or integrity of the Platform
- Suspicion of fraudulent use of the Account
12.2. Termination
In the event of a continuing breach after formal notice remaining without effect for fifteen (15) days, Kappn may permanently terminate the User’s access to the Platform, without prejudice to any damages and interest.Article 13 — Reporting unlawful content
In accordance with Article 6 of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN), any User may report manifestly unlawful content to [email protected] by providing the information required under Article 6-I-5 of said law.Article 14 — Modification of the GTU
Kappn reserves the right to modify these GTU at any time. The version in force is the one accessible on the Platform. Registered Users will be informed of any substantial modification by email at least fifteen (15) days before the new version comes into force. Continued use of the Platform after this date constitutes acceptance of the modified GTU.Article 15 — Applicable law and jurisdiction
These GTU are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts of Paris shall have exclusive jurisdiction.Article 16 — General provisions
Entire agreement: These GTU, together with the GTC, the Privacy Policy, and the DPA, constitute the entire terms governing the use of the Platform. Partial invalidity: If any clause of these GTU is declared null or unenforceable, the other clauses shall remain in full force and effect.
